A man who engaged in sexual acts with his younger sister when he was just a teenager knew his behaviour was “seriously wrong”, prosecutors have told Hong Kong’s High Court.
Senior Public Prosecutor Karen Ng Ka-yuet said on Thursday that the older sibling, believed to have been aged between 11 and 14 at the time of the alleged offences, was fully aware that the acts involving his sister, three years younger, were inappropriate.
The five alleged incidents took place on unspecified dates only weeks apart, sometime between 2013 and 2016, at the family’s home in Sha Tau Kok. The sister, now 20, filed a police report in 2021.
The defendant, now 24, has denied four counts of incest and three counts of indecent conduct towards a child under the age of 16.
Ng said the indecent acts were charged separately from the incest counts because they concerned different sexual conduct.
The prosecution’s evidence draws on statements from the defendant, in which he admitted to these acts. The sister is not set to testify in court.
Ng told the court that the defendant had initiated the first sexual act and made subsequent requests over a period of about two months.
While the prosecution’s opening remarks described most of the alleged acts as sexual intercourse, rather than rape, Ng explained that it was only necessary to prove the defendant had intercourse with the person, whom he knew to be his sister, for the offence of incest.
The jury heard the defendant had admitted to police that he engaged in such acts with his sister, telling officers: “At that time, I was very young, but I admit that I did do it. I now regret it a lot as well.”
Ng claimed the language used by the defendant towards his younger sister during the alleged incidents showed he had “a clear degree of maturity beyond a child of similar age”.
“The repeated sexual acts between brother and sister, as admitted to by the defendant, could not be excused as being childish, playfulness, naughtiness or simply innocent,” she said.
The senior prosecutor asked the jury to look at the circumstances behind each alleged act, arguing that it would become clear to them that “the defendant – even when he was just between 11 and 14 years old – knew what he was doing to his younger sister was seriously wrong”.
The trial continues on Friday.
